India is set to implement the 2025 Immigration and Foreigners Act, which aims to strengthen national security, simplify visa policies, and promote economic growth. If passed, this law will overhaul existing regulations, imposing stricter penalties for violations and enhancing measures to prevent illegal immigration.
Stricter Penalties and Regulations
The proposed law introduces severe penalties for using forged passports or visas, with offenders facing up to seven years in prison and a fine of ₹100,000. Foreigners entering without valid documents may face up to five years in prison and a fine of ₹50,000. Hotels, universities, and hospitals must report detailed information about foreign guests to immigration authorities.
New Regulations for Airlines and Shipping
International airlines and shipping operators must submit crew and passenger lists at designated entry points to enhance transparency and immigration control.
Government Control Over Foreigner-Frequented Areas
The law empowers the central government to regulate areas frequently visited by foreigners, potentially including closures or operational restrictions in sensitive areas.
Unifying Indian Immigration Laws
The new law integrates existing immigration laws into a single framework, retaining key provisions while introducing new clauses to address contemporary security challenges and facilitate business.
Balancing Security with Economic Growth
The law aims to strengthen national security while making India a global hub for business and tourism. It does not address citizenship issues.
India’s Foreigner and Visa Policies
India issues physical and electronic visas. Visa-on-arrival facilities are available at six airports for citizens of Japan, South Korea, and some UAE nationals.
Growing Number of Foreign Visitors
India welcomed over 1 million foreign tourists between January 2023 and December 2024. The new law aims to create a safe environment for legitimate visitors while combating illegal immigration.
If approved, the law will redefine India’s immigration landscape, making it more streamlined, security-driven, and business-friendly.
