Simply deporting them has not been effective, as many members have re-entered the country multiple times.
During the Biden administration, there was a significant increase in illegal border crossings, and while Trump has reduced these incidents, the gangs continue to find ways to re-enter. Once in the U.S., they can hide among the large number of illegal migrants and are often protected by “sanctuary” laws and immigration advocacy networks.
The Trump administration has cited the 18th-century Alien Enemies Act as legal authority for its actions. However, this law was originally intended for wartime situations declared by Congress. The current “war” is based on Trump’s presidential declaration that Tren de Aragua is invading the country. Challenging this in court is legitimate, and Judge Boasberg’s decision to halt new flights until arguments can be heard is part of the legal process.
The administration did not defy Judge Boasberg’s order by allowing the first two flights to land in Honduras and El Salvador. The case is likely to reach the Supreme Court, raising questions about whether the federal government can declare someone a gang member and deport them without due process.
Elon Musk’s support for impeaching Judge Boasberg has been criticized as reckless. The Biden administration took years to create the current immigration situation, building on previous mistakes.
