DeSantis signs bill expanding Florida’s ‘Move Over Law’

Florida’s ‘Move Over Law’ expansion has been signed by Governor Ron DeSantis.

Prior to the law’s expansion, Florida’s Move Over Law said drivers must vacate the lane closest to stopped law enforcement, emergency, sanitation, and utility service vehicles, tow trucks or wreckers, and maintenance or construction vehicles with displayed warning lights without advanced signs or channelizing devices.

The expansions for the bill, known as CS/CS/CS/HB 425 – Transportation, will go into effect on Jan. 1, 2024. It adds three more situations to Florida’s Move Over Law.

These rules require motor vehicles to move over in the following circumstances:

• For a disabled motor vehicle that is stopped and displaying warning lights or hazard lights.
• A vehicle is stopped and is using emergency flares or posting emergency signage.
• A vehicle is stopped, and one or more persons are visibly present.
