Policy and Resources Committee Directed to Release Employment Reference Following Data Protection Order

In a recent development, the Office of the Data Protection Authority in Guernsey has mandated the Policy and Resources Committee (P&R) to release an employment reference, marking a significant win for data protection rights in the region.

The issue arose when a jobseeker, whose offer of employment was rescinded after a reference was provided, exercised their access request rights under The Data Protection (Bailiwick of Guernsey) Law, 2017. Despite being entitled to certain information about themselves, the jobseeker was denied access to the reference by P&R on the grounds that it contained information about other individuals.

P&R justified their decision by conducting a balancing test, determining that the interests of the reference writer outweighed those of the jobseeker. However, the Data Protection Authority’s investigation revealed that P&R had failed to adequately consider the jobseeker’s significant interests in accessing the reference.

This case underscores the importance of individuals being able to understand and validate information about themselves, particularly when it may impact their employment prospects. By denying the jobseeker access to the reference, P&R hindered their ability to challenge the recruitment decision and exercise other rights under the law.

As a result of the Authority’s intervention, P&R was found to have breached the law by withholding information that the jobseeker was entitled to receive. An Enforcement Order was issued to compel P&R to provide the reference, with redactions as agreed upon by the Authority, which was subsequently complied with.

This case serves as a reminder that everyone has a right to know what is being said about them, especially in contexts like employment references. Moreover, it highlights the need for organizations to conduct thorough assessments when handling personal data that pertains to multiple individuals.

In response to the Authority’s decision, the Policy and Resources Committee expressed concerns about the confidentiality provisions surrounding job references, indicating a need for potential legislative changes to address the issue. They emphasized the importance of preserving the integrity of job references while ensuring compliance with data protection laws.
