Nissan has reached a significant settlement in response to a class action lawsuit stemming from a data breach that occurred on December 11, 2017. In 2018, two separate class actions were initiated: one in the Ontario Superior Court of Justice and another in the Superior Court of Quebec. The Ontario action represented Canadian residents (excluding Quebec) with active leases or loans with Nissan during the specified period from December 22, 2016, to January 12, 2017. The Quebec action included individuals who had similar financial engagements and those directly notified by Nissan about the breach in January 2018.
These lawsuits aimed not only for financial compensation but also sought to hold Nissan accountable for its data protection practices, advocating for enhanced standards of consumer data security.
After extensive negotiations, Nissan has agreed to establish a settlement fund of CAD $1,820,000 to compensate affected customers while denying any wrongdoing—a common practice that allows companies to resolve disputes without admitting liability. This settlement framework includes provisions for both documented and undocumented claims:
