Rising Threats To Judges Endanger Rule Of Law, Chief Justice Roberts Warns In Year-End Report

In his annual year-end report, U.S. Supreme Court Chief Justice John Roberts raised alarm over the rising threats of violence, intimidation, and political interference that, he warns, endanger the very foundation of judicial independence in the United States. As America continues to grapple with increasing polarization, Roberts emphasizes that the rule of law is at risk due to the escalating hostility judges face in performing their constitutional duties.

“In this nation, there is no place for violence directed at judges simply for doing their job,” Roberts stated in the report, noting the growing dangers to judicial independence in a time when the judiciary is under greater scrutiny than ever. He identified four primary threats: violence, intimidation, disinformation, and the dangerous trend of defying court rulings. These forms of illegitimate activity, Roberts asserts, are not only a threat to judges but to the entire structure of the judicial system.

Citing recent statistics from the U.S. Marshals Service, Roberts highlighted a troubling increase in threats against federal judges, with hostile communications tripling over the past decade. In the last five years alone, more than 1,000 serious threats have been made, prompting enhanced security for some judges, including full-time protection and even bulletproof vests in extreme cases.

“The lives of judges and their families have been put at risk,” Roberts remarked. “In 2005 and 2020, relatives of federal judges were killed in targeted attacks by assailants seeking revenge for rulings they found unfavorable. More recently, state judges in Wisconsin and Maryland were murdered in similar attacks following adverse decisions.” These cases underscore the personal danger judges face when carrying out their duties.

Roberts also condemned the practice of doxxing, where private personal information such as home addresses and phone numbers are publicly shared, leading to physical confrontations or aggressive harassment. This includes a disturbing episode in 2022 when an armed man was arrested near Supreme Court Justice Brett Kavanaugh’s home following the controversial decision to overturn Roe v. Wade.

In his report, Roberts also expressed concern over political leaders attempting to interfere with the judicial process by maligning judges and questioning their impartiality. While not naming specific individuals, Roberts’ remarks appeared to be a subtle criticism of former President Donald Trump, who has frequently attacked the integrity of judges presiding over his legal cases.

Roberts’ criticism of political interference echoed past confrontations. In 2018, Roberts rebuked President Trump for calling a judge who ruled against his administration’s asylum policy an “Obama judge.” In 2020, he condemned Senate Majority Leader Chuck Schumer for threatening Supreme Court justices in a speech, warning them they would “pay the price” for their decisions.

The Chief Justice’s report comes amid a significant erosion of public trust in the Supreme Court and the broader judicial system, sparked by controversial rulings and ethical scandals involving some justices. Despite the growing discontent, Roberts chose not to address these issues in his report, a decision that has drawn criticism from lawmakers like Rep. Jamie Raskin, who argued that the report ignored the ethical challenges facing the Court.

Raskin, who is set to assume the top position on the House Judiciary Committee, noted, “While I agree with Roberts’ call to safeguard judges from threats and violence, the Supreme Court’s failure to address its own ethical crisis has significantly undermined the public’s faith in its legitimacy.”
