TikTok and its parent company, ByteDance, issued a stark warning during Supreme Court arguments on a pivotal case that could force the popular short-video platform to sell or face a nationwide ban. The law, which mandates ByteDance to divest TikTok or face a ban by January 19, is being challenged on constitutional grounds, with TikTok arguing it infringes on First Amendment rights.

TikTok’s lawyer, Noel Francisco, cautioned that if the law is upheld, it could pave the way for similar measures targeting other businesses, potentially leading to censorship in various industries. He pointed to the example of AMC movie theaters, which were once owned by a Chinese company, arguing that Congress could eventually mandate these businesses to censor content or push certain agendas.

Fisher questioned why TikTok alone was singled out, despite the presence of other platforms with equally significant user data under potential Chinese influence.

As the clock ticks down to the January 19 deadline, tensions remain high over the law’s potential impact on free speech and the broader implications for U.S. companies. The Supreme Court’s decision on the matter could set a critical precedent that extends far beyond the social media landscape.
