Federal Court Keeps Block On Iowa Immigration Law, Dismisses Second Suit

A federal appeals court has upheld a temporary block on an Iowa law that makes it a state crime for undocumented immigrants to be in Iowa. The court sided with the Biden administration and an immigrant rights group, which had sued Iowa over the law in May. The law is similar to those in Texas and Oklahoma, which are also on hold as courts consider whether they overstep federal immigration authority.

The law would allow state and local officials to arrest and charge people with outstanding deportation orders or those previously removed from the US. The federal appeals court ruled that the state law would likely conflict with federal immigration enforcement and complicate US foreign policy.

However, the court also issued a second decision that could affect future legal proceedings. It ordered the dismissal of a separate lawsuit filed by the Iowa Migrant Movement for Justice on behalf of its organization and two individuals. The court ruled that this lawsuit is now moot because of the federal government’s case against Iowa.

Veronica Fowler, communications director for the ACLU of Iowa, which is representing the Iowa Migrant Movement for Justice, said they are still determining their next legal steps. “We are committed to doing everything we can to strike down this really terrible law,” she said.

The Department of Justice did not immediately comment on the future of the lawsuit, which would proceed in the lower court.

Under President Joe Biden, Republican governors and lawmakers had accused him of failing to enforce federal immigration law and manage the southern border. Many are now supporting President Donald Trump’s promise to crack down on illegal immigration and deport undocumented immigrants.

In December, 26 Republican governors, including Iowa Gov. Kim Reynolds, pledged to use “every tool at our disposal” to support Trump’s immigration policies. Iowa Attorney General Brenna Bird said the legal battle is far from over. “As President Trump works nationally to fix the mess Biden and Harris created on the southern border, we will continue fighting in Iowa to defend our laws and keep families safe,” she said.
