Meta Platforms has petitioned a U.S. court to rule that its use of books by authors like Ta-Nehisi Coates and Sarah Silverman to train its AI system, Llama, constitutes “fair use” under copyright law.
This defense could be pivotal in similar cases involving AI training. Meta argues that its use is transformative, enhancing Llama’s capabilities without replicating the authors’ works.
The authors sued Meta in 2023, claiming unauthorized use of pirated books. Meta counters that fair use allows such use under specific conditions, emphasizing its role in driving innovation.
The case, Kadrey v. Meta Platforms Inc, is ongoing in the U.S. District Court for the Northern District of California. The authors’ legal team includes David Boies and Joseph Saveri, while Meta is represented by Bobby Ghajar and others.
