Rochester and Olmsted County Law Enforcement’s Response to New School Resource Officer Law

The Education Omnibus bill recently passed a law that places restrictions on the use of certain restraints by school resource officers, including the prone position often employed for handcuffing individuals. Law enforcement agencies statewide have expressed concerns about the law, claiming it jeopardizes both officer and student safety.

Olmsted County Sheriff Kevin Torgerson contends that the law is problematic, emphasizing the lack of input from law enforcement during its formulation. Torgerson argues that handcuffing individuals while they are on the floor, typically on their stomach, is the safest and most effective way, particularly during confrontations. He suggests that officers may now need to adopt a more hands-off approach in situations that require immediate intervention.

Senator Carla Nelson (R-Rochester) concurs that the law was hastily enacted without thorough consideration, and she believes a special session is necessary to clarify its implications. Many lawmakers and officials share this sentiment, including Minnesota Republican Party Chair David Hann, who called for a special session.

Rochester Police Captain Jeff Stilwell acknowledges that the law requires revisions but highlights the positive partnership between the department, the county, and the Rochester Public School District. Despite the challenges posed by the law, school resource officers will continue to serve in the RPS district and other Olmsted County schools.

During a visit to Rochester, Governor Tim Walz expressed openness to a special session, acknowledging concerns from certain districts and police departments. He emphasized ongoing efforts to find a compromise, stating that some areas, like Rochester and Bloomington, have successfully addressed the issue through negotiation and collaboration.
