New York State Implements Pay Transparency Legislation

Starting this Sunday, employers in New York State must embrace greater transparency in their job postings by disclosing compensation ranges. Governor Kathy Hochul signed this comprehensive pay transparency law late last year, which applies to employers with four or more workers.

The legislation mandates that employers include compensation ranges in all job, promotion, or transfer opportunity advertisements. This requirement applies to positions performed at least partially within New York State. Even roles conducted remotely or telecommuting opportunities that report to a supervisor, office, or other work site in New York State are subject to this regulation.

Supporters of pay transparency have argued that unveiling the shroud of secrecy surrounding wages can play a pivotal role in rectifying long-standing workplace inequities.

Governor Hochul emphasized the significance of this law, stating, “Wage disparities have perpetuated inequality in our state for far too long, disproportionately affecting women and people of color.”

State authorities cite a recent report indicating that, in 2021, women in New York’s workforce earned just over 88 cents for every dollar earned by men.

The new law stipulates penalties of up to $3,000 for violations.
